| Acceptable Payment Types and Billing |

| Due to the nature of how we are billed for these accounts, a deposit of the "final months" service fee's is required. Payment types acceptable for DSL accounts include Visa, Mastercard, American Express, Discover and ACH (Automatic Bank Account Withdrawal). No cash or statement based methods are acceptable from residential or new business accounts. Existing customers may qualify based on their payment history, please contact our Billing Department for more information. 30 days notice is required to terminate service. Should a scheduled payment be refused via the automatic payment method, you will be informed and will have 2 weeks to take care of any fee's due and provide us with a new automatic payment form, otherwise your service will be terminated 30 days later. |

| Guarantee of Service |

Until DSL service is established and the speed determined, Datacruz cannot guarantee either that a connection can be established or the maximum speed available. This is due to the way that DSL service is established. We fully expect 99% of the time that the estimates given to us of both availability and speed to be accurate. Should a higher service level be desired than what is available, service fee's will either be prorated to the lower level or service can be cancelled at that time.
Due to the nature of DSL service, it should not be used in any instance where a guarantee of service speed and/or quality is required. While we expect this type of service to allow for very high speed access to all of our subscribers, we cannot guarantee this level. Should a guaranteed level of service be desired, we recommend you look at one of our other dedicated solutions, from ISDN through T1/T3 service. With these types of service we can guarantee the quality and connectivity between us. |

| Usage of Service |

Due to the "broadband" or "shared" nature of the DSL service, it is not intended (unless otherwise noted in the Mailserver Plus and/or ServerPlus packages) to be used to host any sort of "server based" system (IRC Server, FTP Server, Web Server, etc. etc.). Should a user be found in violation of these restrictions, Datacruz reserves the right to limit its impact through the use of bandwidth restrictions, higher pricing, and/or other forms of limiting the server activity, and in extreme cases, we reserve the right to terminate accounts for this type of violation. In this case, this is the industry norm in handling this type of problem, we choose to be one of the few providers that is up front about it.
Why does it need to be this way? For the vast majority of our DSL users, we expect them to be doing normal tasks such as web-browsing, reading and sending email, perusing Usenet Newsgroups and possible transferring files via FTP. One user running a server that is giving out anything from MP3 files to pornographic pictures or even pirated software will use the bandwidth of 10 to 20 normal users, thus slowing all of them down. And although we aren't concerned about the normal user using alof of bandwidth while they are surfing the internet, the user who sets up a file server of some sort that sits around 24x7 and soaks up bandwidth will not be permitted.
We would like to stress that for normal client side use -- in other words what virtually all of you do today, browsing the web, getting and sending e-mail, reading USENET newsgroups -- the DSL circuit is a perfect vehicle. |
